This message contains information about amendments to environmental and occupational health & safety-related acts and regulations in Canada. ACTS
Canadian Environmental Protection Act, 1999: SOR/2010-98 adds 6 toxic substances to schedule
1 of the act.
REGULATIONS
Concentration of Phosphorus in Certain Cleaning Products Regulations (Canadian
Environmental Protection Act, 1999 ): SOR/2009-178 is now in force amending the title of the
regulations (formerly Phosphorus Concentration Regulations). Section 3 is replaced and new
sections 4 - 8 have been added regarding household dishwashing compounds, household
cleaners, accreditation by a laboratory and record keeping.
BRITISH COLUMBIA
ACTS
Carbon Tax Act: S.B.C. 2010, c. 6 amends subsections 57(1) and (2) and 64(14)(b)(ii) by referencing the Supreme Court Civil Rules. S.B.C. 2010, c. 21 adds subsection 71(2) and makes further amendments to reflect this change.
Environmental Assessment Act: S.B.C. 2010, c. 22 amends paragraph 11(2)(b).
Environmental Management Act: S.B.C. 2010, c. 21 adds paragraph 46(1)(g.1) and subsection 46(2.1).
Forest Act: S.B.C. 2010, c. 6 makes minor amendments to subsections 142.91(1) and (2). S.B.C. 2010, c. 11 amends subsection 8(5) and ss. 94 and 105 replaces clauses 75.1 (2)(a) and (b) and adds s. 94.1 regarding scaling of special forest products. Several other amendments are made
regarding references to the minister. S.B.C. 2010, c. 21 adds paragraph 54(2)(d.1) and subsection 54(3). S.B.C. 2010, c. 22 amends clause 47.7(f)(ii) and adds Division 4.1 after section 79.
Forest and Range Practices Act: S.B.C. 2010, c. 11 amends s. 67 regarding the seizure of timber.
Foresters Act: S.B.C. 2010, c. 6 amends subsections 28(1) and (2) by referencing the Supreme Court Civil Rules.
Greenhouse Gas Reduction (Cap and Trade) Act: S.B.C. 2010, c. 21 amends ss. 37, 39 and 45.
Greenhouse Gas Reduction (Renewable and Low Carbon Fuel Requirements) Act: S.B.C. 2010, c. 21 amends sections 1, 8, 10 and 25-27, and paragraphs 6(3)(b) and 24(3)(c). Subparagraph 22(3)(c)(ii) is replaced.
Health Act: S.B.C. 2010, c. 6 amends subsection 9(4) by referencing the Supreme Court Civil Rules.
Passenger Transportation Act: S.B.C. 2010, c. 6 amends the definition of "temporary operating permit" and makes minor amendments to subsection 30(2) and clause 59(2)(p).
Protected Areas of British Columbia Act: S.B.C. 2009, c. 19 amends Schedules C and D. S.B.C. 2010, c. 13 makes several amendments to the Schedules of this Act.
Public Health Act: S.B.C. 2010, c. 6 amends ss. 117 and 118 by referencing the Supreme Court Civil Rules and adds subsection 9(2) referencing the Ministry of Health Act.
Transportation Act: S.B.C. 2010, c. 6 replaces paragraph 82(1)(b)(i).
Utilities Commission Act: S.B.C. 2010, c. 22 replaces the definitions of "demand-side measure" and "Government's energy objectives" and repeals the definition of "transmission corporation". Further amendments are made reflecting these changes as well as referencing the Clean Energy
Act.
Wildfire Act: S.B.C. 2010, c. 11 amends ss. 3 and 17, replaces subsection 17(4), adds paragraph 17(5)(a.1) and makes several other minor amendments. S.B.C. 2010, c. 22 amends subsections 7(3) and 43(3), adds subsections 7(2.1) and (2.2) and replaces paragraph 72(2)(g).
Workers' Compensation Act: S.B.C. 2010, c. 6 amends subsection 247(2) by referencing the Supreme Court Civil Rules.
REGULATIONS
Elevating Devices Safety Regulation (Safety Standards Act): B.C. Reg. 105/2010 amends Item 4 of the "Canadian Standards Association (CSA) Standards" table contained in the Schedule.
MANITOBA
ACTS
Highway Traffic Act: S.M. 2009, c.6 adds section 186.1 prohibiting smoking in motor vehicles if a child is present, and adds section 215.1 which prohibits the use of hand-operated electronic devices while driving.
NORTHWEST TERRITORIES
Fire Prevention Regulations (Fire Prevention Act): R-035-2010 replaces paragraph 2(1)(c) to update the reference to CSA B139-09 Installation Code for Oil-burning Equipment, 2009 edition.
ONTARIO
ACTS
Environmental Protection Act: S.O. 1997, c. 7 replaces ss. 102 to 105 and repeals sections 106 to 121, resulting in the dissolution of the Environmental Compensation Corporation.
Provincial Offences Act: S.O. 2009, c. 33, Sch. 4 replaces s. 45 regarding a taking of plea and s. 83.1 regarding appearance by electronic method and adds subsections 111(4) and 159(1.0.1).
REGULATIONS
Designated Substances Regulation (Occupational Health and Safety Act): O. Reg. 259/10 replaces Table 1 outlining exposure limits.
General (Clean Water Act, 2006): O. Reg. 246/10 replaces ss. 19 to 23 and adds ss. 24 to 68 which provide enhanced requirements for preparing source protection plans. The legislation addresses municipal and public involvement in the planning process as well as providing interim authority to municipalities to manage significant drinking water threats. Further amendments are made to reflect these changes.
Records of Site Condition - Part XV.1 of the Act (Environmental Protection Act): O. Reg. 245/10 amends clause 21.1(1)(d) and replaces subsections 21.1.(2) and (3). Report Section 7 of Schedule C regarding the risk management plan is also replaced.
QUEBEC
ACTS
Act respecting off-highway vehicles: 2009, c. 18, ss. 7, second paragraph of 21.1 enacted by s. 8, s. 12, first paragraph and s. 18 are now in force regarding certified operation of modified vehicles.
